Reporters Federation: absentee trial of media by the Taliban is non-religious and illegal

 

Silk Way Weekly: Reports Federation and Afghanistan media institutions in a reaction to Abdul Haw Hemad, the Taliban acting director for overseeing media of the Ministry of Culture and Information, (on Tuesday, Jan 3, 2023), said Trial in Absentia of Afghan media in overseas is non-religious and illegal.

Abdul Haq Hemad, accused Afghan media overseas of propagating against the Taliban and “destroying the system” and added that such media will be tried and their verdicts will be issued in the near future.

Hemad said the file of those media propagating against the Taliban will be sent to the court and the court ruling will be issued in the coming days.

At the same time, Reporters Federation and Afghan Media institutions said a trial absentee in Islam is only in the case of infringement of the rights of others and does not apply to the media.

According to the Reporters Federation, International human rights laws also just recognizes the absentee trial in the case of infringement of the rights of others.

According to Reporters Federation, currently no law is enacted in Afghanistan and the Taliban say Hanafi’s jurisprudence is the base of their actions. However, Hanafi’s jurisprudence approves absentee trials only in the case of infringement of the rights of others.

Reporters Federation and Afghan media agencies urge the UN and international community to prevent Taliban “violent behavior” and not allow them to violate the rights of the media community of Afghanistan.

After the Taliban seized power on 15 August 2021, they restricted media and as a result, more than 300 media outlets stopped their activities, and a number of the resumed their activities overseas.
